Here at Weber, we respect our customers’ privacy, and at the same time are dedicated to making your grilling experience the very best in the world.

For the purpose of our keeping customers’ personal information of Weber (hereinafter referred to as the “Personal Information”), we, Weber-Stephen Products (Japan) GK (hereinafter referred to as “Weber”) hereby sets out this privacy policy (hereinafter referred to as this “Policy”) as follows and establishes system for protecting such Personal Information. Weber will comply with laws and regulations with regard to personal information, will recognize the importance of protection of personal information and thoroughly deal with such protection and will treat properly and protect such Personal Information.

Additionally, in this Policy, “Personal Information” means any information with regard to a living individual which enables to identify the specific individual by name, birthdate or other descriptions contained in such information (including such information as will allow easy reference to other information and will thereby enable the identification of the specific individual) and which contains an individual identification code such as passport number, drivers’ license number.

  • data which are collected from sales orders, applications, consent or other forms, personal documents,
  • data collected through participation in customer satisfaction surveys, Weber and dealers, third-party vendors, service providers, and/or other partners,
  • data provided by you such as comments, queries or messages that you may submit to Weber in whatever manner, and
  • data from publically available sources.

b. Opening of Account/Weber-ID

Customers can establish a Weber-ID on the website of Weber (hereinafter referred to as the “Site”) for free. With a Weber-ID, you have access to exclusive content on the Site (recipes, tips, and tricks, etc.), you can register your grill(s) and other products, maintain all relevant information for them (warranty, instructions), save products you are interested in, check order status, and otherwise have central access for all data and services that Weber offers you. 

In addition, the Weber-ID is used to provide registered users with personalized and individualized service on the Site. Accordingly, Weber will collect and analyze the following data on the user’s behavior or others:

  • Email address
  • Name and Address
  • Orders and cart
  • Saved products
  • Email list status
  • Registered products
  • Customer service/online consumer care claim information

2. Use of Personal Information

Weber will use the Personal Information for the following purposes:

  1. to help Weber verify your identity when you contact us,
  2. to send products that you purchased and send gifts to you,
  3. to respond to inquiries, comments, and suggestions from you, warranty support, user registration, or others,
  4. to enable Weber entities, dealers, partners, approved third-party vendors, and/or service providers to provide you with your requested products or services,
  5. to help Weber detect and prevent fraud and/or illegal activities,
  6. for general administration purposes,
  7. for audit and risk management purposes,
  8. to conduct research, surveys, and trend analysis on various matters, such as for product development, statistical, security, and testing purposes,
  9. to deal with the mailing and communication of information literature (e.g. notification and invitations of products, services and exclusive events, information on promotions and offers, sending marketing materials or leaflets or booklets and/or e-newsletters &, etc.),
  10. to identify other products and services which might be of interest to you and to inform you about Weber’s products and services, and
  11. Any purposes incidental to the above.

3. Prohibition of Personal Information from Providing to Third Party

Weber will properly manage the Personal Information acquired from customers and will not provide such Information to any third party, including group companies of Weber located in foreign countries, unless it falls upon any one of the followings, however, “third party” herein does not include a person, excluding such located in foreign countries, whom Weber consigns all or part of the treatment of the Personal Information within necessary extent for attaining the purpose of use:

  1. cases in which principal consents,
  2. cases based on laws and regulations,
  3. cases in which there is a need to protect human life, body, or fortune, and when it is difficult to obtain a principal’s consent,
  4. cases in which there is a special need to enhance public hygiene or promote fostering healthy children, and when it is difficult to obtain a principal’s consent, or
  5. cases in which there is a need to cooperate in regard to a central government organization or a local government, or a person entrusted by them performing affairs prescribed by laws and regulations, and when there is a possibility that obtaining a principal’s consent would interfere with the performance of the said affairs.

4. Provision of Personal Information to Third Party Contractors

Weber may provide other Weber group entities, third-party’s contractors, or others within or outside Japan with the Personal Information acquired from customers within the necessary scope for attaining the purposes of use such as price settlement, shipment of goods, data processing, data storage, or others. In this case, Weber shall obligate protection of such Personal Information to such Weber group entities and contractors such as execution of confidential agreements and shall control such contractors to let them treat the Personal Information properly.

5. Treatment of Personal Information in Foreign Countries

Weber may provide personal information to any third party located in foreign countries, including affiliated companies of Weber, in order to consign treatment of the personal information or to jointly utilize such information for the operation of our business and its summary are as follows:

Weber, through contracts or others, obliges the destination to take measures for personal information protection.

6. Disclosure of Statistical Data of Information

Weber may collect and analyze the Personal Information acquired from customers and may disclose such Information to any third party after processing such Information into statistical data which is impossible to identify any individual such as the average age of purchasers of our products. In this case, it will be the result of a calculation that is used and disclosed and Weber will not disclose the Personal Information itself to any third party.

7a. Social Media Plug-ins

When you visit the Site, Weber may provide customer list information you may have provided Weber, to Facebook and other social media networks in order to utilize services such as Facebook’s Custom Audience and pixel services. If you have actively clicked the applicable link yourself by a social media plug-in, your Internet browser will establish a connection to the servers of the relevant social network; therefore, by clicking the appropriate button (e.g. “Like”), you give your consent to your Internet browser establishing a connection to the servers of the relevant social network and transmitting data relating to the use of the website to the relevant social network provider. Once you have directly engaged with the relevant social media website, your use and browsing will be governed by the data protection statements/privacy policies of the relevant providers.

7b. Facebook Pixel

When using our web page, we place a visitor action pixel of the social network Facebook Inc., 1601 S. California Ave., Palo Alto, CA 94304, USA (“Facebook”) on your computer. This allows us to track your behavior when you click on a Facebook advertisement and are then redirected to our web page. The service helps to analyze and evaluate the effectiveness of Facebook advertisements in order to optimize future advertising measures. The data will remain completely anonymous to us and cannot be traced back to the respective person. However, Facebook will store and process the data and hence establish a connection between the data and the user's Facebook profile. 8. Request for Disclosure of Personal Information or Record with Regard to Provision to Third Party

When customers request to disclose their own Personal Information or record with regard to provisions to third parties, Weber will disclose such to the customers without delay. However, when it should fall upon any one of the following resulting from the disclosure of the Personal Information, Weber may not disclose all or part of such Information and give notice of such non-disclosure to the applicant customers without delay. Additionally, Weber will charge 1,000JPY per request as a handling charge upon disclosure of the Personal Information or record with regard to the provision to the third party:

  1. when such disclosure may harm life, body, property, or other rights and interests of the applicant customers or any third party,
  2. when such disclosure may cause material trouble for the proper implementation of Weber’s businesses, or
  3. when such disclosure may breach any laws and regulations.

9. Request for Correction, Cease of Utilization of Use or Others of Personal Information

If customers request to correct, add, delete, or cease to utilize your own Personal Information or to cancel to provide such to any third party or others, Weber will deal with such request after proper identification.

10. Security of Personal Information

Weber will keep the Personal Information accurate and in the latest condition and will take necessary measures such as maintenance of security system and administration system, in-depth employees’ training, or others in order to prevent unauthorized access, loss, damage, falsification, leak or other of the Personal Information, implement safety measures and carry out strict management of the Personal Information. Also, when Weber needs not to use Personal Information, we will make an effort to delete such without delay.

11. Safety Measures of Personal Information

Weber will take the best security measures in order to ensure the accuracy and safety of the Personal Information.

12. Compliance with Laws and Regulations

Weber shall be in compliance with Japanese laws and regulations applicable to Personal Information and shall make an effort to improve this Policy by reviewing such contents according to amendments of such laws and regulations.

13. Amendment of this Policy

This Policy may be updated from time to time due to technical updates and appropriate implementation of new technologies and/or due to changes in applicable laws and regulations without notification to customers. This amended Policy shall be effective at the time when such Policy is published on the Site unless Weber otherwise sets out.

Weber loves to see our products being used to make delicious meals on social media in real life! We might ask about the possibility to share the pictures that you have posted on social media, on our website, or on our other platforms, such as our Weber newsletter, etc.

LICENSE OF USE

By replying #yesweber on a photo after Weber has sent Instagram or other social media channels a message requesting this usage, hereinafter referred to as "picture(s)," you agree to the following:

You provide Weber-Stephen Products (Japan) GK and its affiliates, a global, non-exclusive, royalty-free, permission to use your pictures and posts (the “Work”) for marketing purposes on the website www.weber.com and its local sub-domains and on the social media channels of Weber and its affiliates. This includes publishing, changing and modifying the Work in Weber's sole discretion to align it with the general look and feel of Weber and its affiliates and/or adapt it to technical or visual requirements on the website or social media profile. The above license is granted for an indefinite time.

You guarantee that you hold or manage the rights to the material you submitted and that use of the picture does not infringe on any third party's rights.

These terms and conditions are regulated by Japanese legislation where the competent courts within Japan have sole authority over any controversy occurring therefrom.

PERSONAL INFORMATION PROTECTION AND CONSENT

When using your picture based on the license above, it might occur that Weber processes your personal information, in particular your Instagram profile name. Weber is responsible for marketing and IP-rights management and the fulfillment of personal information obligations.

When you reply “#yesweber” in the comments or attached to the picture we have gotten in touch with you about, you CONSENT to us processing your personal information when publishing the picture for marketing purposes on Weber's website(s) and social media accounts as described above.

Weber processes your personal information in order to perform and manage the license above. Also, when Weber publishes your personal information such as your Instagram profile name, Weber processes such personal information in accordance with your consent obtained through your reply of “#yesweber”.

When Weber transfers your personal information outside Japan, we do so under of Japanese Act on Protection of Personal Information.
