Terms and Conditions for consumer courses

1.     General

  • Each guest must book and pay in full to confirm their place prior to any Grill Academy course or event. In fairness to all guests, only confirmed paid guests may enter the venue or participate in our experiences.
  • The right of participation is limited to ticket holders. Young adults (aged 14-17 years) can attend Weber Grill Academy barbecue classes if they are participating with a parent or guardian (must both have ticket). Please note this on the participant details when booking, to assist our team in identifying underage class participants.
  • Grill Academy allows you to book your course participation directly and with binding effect through the Weber website, which can be reached at the URL www.weber.com/AU The Grill Academy courses described on the website are not binding offers of Grill Academy, but are mere invitations to submit an offer. Participants who have found the item they want can place this item in the shopping basket without entering into any obligation by clicking on “shopping basket”. If a Participant wishes to register other Participants for a Grill Academy course or event, they must enter the names of the other Participants. The Participant can view and edit the contents of the shopping basket at any time by clicking on the basket. If the participant wants to proceed to a binding booking, they must click on “Go to Checkout”. After the Participant has entered or confirmed the billing address and has selected the payment method, an overview of the order will be displayed. Here, Participants can check their selection and details once again. After accepting these terms and conditions of participation, participants can complete the ordering process by clicking on “Buy Now” (Place binding order). The booking for a Grill Academy course or event is a legally binding offer to conclude a contract for participation in the respective Grill Academy course or event.
  • Transactions will be processed in general on a first-come, first-served basis.
  • Bookings will be accepted only if there is still a sufficient number of places available for the Grill Academy course or event in question. Grill Academy will send Participants a registration confirmation to that effect as well as an invoice; however, we expressly point out that the Grill Academy course or event will only run if a minimum number of applications for participation are received. The registration confirmation is at the same time our acceptance of your booking; hence, a legally binding contract for participation in the respective Grill Academy course or event is concluded upon receipt of the statement.

 

2.     Trade Marks

  • The trade marks and logos (collectively the “Trade Marks”) displayed on the site, including those listed below, are registered and unregistered trade marks of Weber and others. Nothing contained on the Site should be construed as granting, by implication, estoppel or otherwise, any licence or right to use any Trade Mark displayed on the Site without the written permission of Weber or such third party that may own the Trade Marks displayed on the Site. Your misuse of the Trade Marks displayed on the Site, or any other content on the site, except as provided in these Terms and Conditions, is strictly prohibited. You are also advised that Weber will aggressively enforce its intellectual property rights to the fullest extent of the law, including the seeking of criminal prosecution.
  • Weber-Stephen Products LLC own the following trademarks; Grill Academy,  Weber® Barbecues, Weber® Barbeques, Weber® Shop and Weber® BBQs.


3. Cancellations & Deferments

We understand life happens. If you need for move your booking, please refer to the guidelines below.

With 10 or more days’ notice, we can transfer your booking to a future date. Please send your request via email to grillacademy@weberbbq.com.au, detailing your current booking information and the date to which you’d like your booking to be moved (you can see future dates and live availability on our website: https://www.weber.com/AU/en/grill-academy/book-bbq-workshop/). Changes are not confirmed until you receive an email confirmation.

With 4 – 9 days’ notice, please contact us by phone (08 8425 9499). Our ability to transfer you at no charge will be impacted by our ability to re-sell your ticket(s) in the notice period provided.

If the ticket(s) remain(s) unsold 48 hours prior to the event, we cannot accommodate a free of charge deferment. You are welcome to substitute the non-attending guest(s) for someone else. Alternatively, you may nominate to pay a re-booking fee of $50 per ticket to select a future date. Please contact us by phone (08 8425 9499) to discuss.

No deferments are available for bookings of 4 or more guests within this notice period. No re-bookings are available for bookings of 4 or more guests within this notice period.

Changes are not confirmed until you receive an email confirmation.

With 2-3 days’ notice, we cannot accommodate a free of charge deferment except for illness (please refer below). You are welcome to substitute the non-attending guest(s) for someone else, subject to being able to accommodate dietary requirements within the notice period provided. Alternatively, you may nominate to pay a re-booking fee of $50 per ticket to select a future date. Please contact us by phone (08 8425 9499) to discuss.

No re-bookings are available for bookings of 4 or more guests within this notice period.

Illness

If you are unwell or test positive to COVID-19 in the days leading up to your booked class, a doctor's certificate, or evidence supporting a positive COVID-19 test, is required to transfer you to a future date.

Please note that this policy applies only to the guest(s) that is unwell, and we cannot accommodate transfers for other members of the booking party. Please contact us by phone initially (08 8425 9499) and then send an email with supporting documentation to grillacademy@weberbbq.com.au

On-the-day cancellations or 'no shows’

No refund or deferment is available to guests who cancel on the day, or for ‘no shows’ – guests who don’t cancel and don’t attend their booked experience.

Class Cancellation by Operator

In the very unlikely event that a class is cancelled by the Weber Grill Academy, a future class will be offered. Refunds are not permitted, and please note that a cancellation of a class is very rare.


4. Variations to advertised classes

  • Fire Bans: On total state fire ban days, the use of solid fuel barbecues will be replaced with alternative barbecues.
  • Certain ingredients or menu items may be subject to change on the day due to seasonality and availability.


5.     Allergies and Dietary Requirements

  • We do our absolute best to cater to Participant's allergies and dietary requirements, however, certain allergies and dietary requirements may not be possible to cater to in some cases. To confirm, Participants must communicate by phone or email with a Grill Academy team member prior to making the booking. 
  • Persons with food allergies or prescribed EpiPens must disclose allergen information to Grill Academy leaders prior to and on the day of the experience. For safety, Participants must bring an in-date EpiPen to the experience and ensure the EpiPen is kept with the Participant who has an allergy at all times.
  • Grill Academy allergy plan is followed at all times.


6.     Attire:

  • Footwear: Closed in, comfortable footwear must always be worn for safety reasons. Footwear which exposes toes, such as thongs or heels, are not permitted.  
  • Clothes must not be loose/flowing, as this can lead to danger when cooking.
  • Long hair must be tied back.
  • Excess jewellery is not permitted during a course.


7. Minors:

  • The Grill Academy is a licenced venue, in which minors (17 years and younger) are not permitted on the premises unless supervised by an adult at a specifically noted children friendly course or event.


8. Responsible Service of Alcohol:

  • Guests will not be served alcohol if they are suspected to be under 25 years old without producing a current Proof of Age or equivalent on request.
  • For the safety and enjoyment of all guests, anyone suspected of being inebriated or under the influence of alcohol or drugs will not be permitted to participate and will be asked to leave the premises.


9. Behaviour

  • All persons must always behave appropriately and safely.
  • All persons must follow all policies and instructions issued by Grill Academy.
  • All persons who revoke the behaviour policy and are asked to leave will not be refunded or credit transferred.


10. Smoking is not permitted on the premises.


11. Health and hygiene

  • All persons must adhere to good personal hygiene to prevent spreading of germs. All participants must wash their hands or use hand sanitiser before entering the premises, and regularly while onsite.
  • All persons must be in good health prior to, and on the day of attendance to any Grill Academy course or event.


12. First Aid

  • Grill Academy will ensure that there is a first aid trained employee at all Grill Academy courses and events.
  • If a Participant sustains an injury, allergic reaction, cut or burn during a Grill Academy course or event, a first aid trained employee will attend to the Participant.
  • An incident report form produced by Grill Academy will be filled out and completed after first aid is rendered, or any potential damage has occurred.
  • Before returning to participation in a course or event, an injured Participant must have been treated appropriately.
  • A Grill Academy course or event may be stopped while first aid is being administered.
  • Emergency services may be called if further assistance is required.


13. COVID 19

  • All persons must adhere to the COVID safe plan produced by Grill Academy.


13.  Limitation of liability

  • Unless otherwise stipulated below, Grill Academy will be liable in accordance with the general statutory provisions. Unless the Parties expressly agree otherwise elsewhere, the following provisions shall apply to all claims for damages irrespective of the legal grounds.
  • Grill Academy does not exclude or limit in any way our liability to the Participants where it would be unlawful to do so. This includes liability for death or personal injury caused by Grill Academy’s negligence or the negligence of Grill Academy’s employees, agents or subcontractors; for fraud or fraudulent misrepresentation; for breach of the Participants legal rights in relation to the products including the right to receive products which are: as described and match information Grill Academy provided to the Participant and any sample or model seen or examined by the Participant; of satisfactory quality; fit for any particular purpose made known to Grill Academy; supplied with reasonable skill and care; and for defective products under the Consumer Protection Act 1987.
  • Grill Academy is responsible to the Participants for foreseeable loss and damage caused by Grill Academy. If Grill Academy fails to comply with these terms, Grill Academy is responsible for the loss and damage the Participant suffers that is a foreseeable result of Grill Academy breaking the contract or Grill Academy failing to use reasonable care and skill, but Grill Academy is not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract was made, both Grill Academy and the Participant knew it might happen.
  • Grill Academy is not liable for business losses. If the Participant uses the products for any commercial, business or re-sale purpose, Grill Academy will have no liability to the Participants for any loss of profit, loss of business, business interruption, or loss of business opportunity.
  • If a Person chooses to attend a Grill Academy course or event, they are doing so at their own risk.

 

14.  Postponement/Cancellation of Grill Academy courses or events

  • In exceptional circumstances beyond Grill Academy’s sphere of responsibility, Grill Academy reserves the right to postpone or cancel a Grill Academy course or event. This is especially the case in the event of a lack of participants, short-term cancellation of staff due to illness or other human resources essential for the conduct of the Grill Academy course or event, or due to force majeure.
  • If the minimum number of participants is not achieved, the Grill Academy course or event may be cancelled.
  • If the Grill Academy course or event is postponed or cancelled, Participants are entitled to withdraw from the contract. Fees already paid will be refunded in full, or transferred.

 

15.  Image and sound recordings

  • Participants are entitled to take photos while on premises at Grill Academy Australia and also to publish them for private purposes, provided that the people clearly visible in those photos expressly consented. It is strictly prohibited to make any film or sound recordings of any kind, unless Grill Academy has granted an express exceptional authorisation on a case-by-case basis, which may, however, be refused by Grill Academy at its discretion.
  • Participants images may be taken as part of photography activity for use on social media, website and marketing purposes.  Should you wish to not be photographed, please let a staff member know prior to your class.

 

16.  Descriptions of the experiences / Illustrations

  • The descriptions of the Grill Academy courses and events on the Weber website are accurate at the time they are uploaded. However, the content of the offered Grill Academy course or event may be subject to minor changes.
  • The times indicated for the duration of the respective Grill Academy course or event are mere indications of the scheduled time frame. Minor time variations in the duration may therefore occur. Accordingly, the times indicated on the Weber website are non-binding and may vary.

 

17.  Discretion

  • Grill Academy reserves the right to discontinue participation for any Person:
  • Who does not comply with all requirements in this policy
  • Who puts other Participants or Grill Academy staff at risk
