eGift Card Terms and Conditions – Canada

These E-Gift Card Terms and Conditions apply to the creation and distribution of eGift Cards for use on www.weber.com/CA (“Gift Cards”). Please see www.weber.com/CA for additional Terms and Conditions.

General Terms

The Gift Cards are issued by Weber-Stephen Canada Company a Nova Scotia corporation ("Weber" or “We”), subject to these E-Gift Card Terms and Conditions ("Gift Card Terms & Conditions"). Weber reserves the right to change these Gift Card Terms & Conditions from time to time to their discretion. No fees apply to Gift Cards, and Gift Cards do not expire. If any of these Gift Card Terms and Conditions are deemed invalid, void, or for any reason unenforceable, that unenforceable term will be deemed severable and will not affect the validity and enforceability of any remaining Gift Card Terms and Conditions.

Returns

Weber eGift Cards are not returnable and cannot be redeemed or exchanged for cash (unless required by law), check, or credit. If consumers resident in Quebec with a card value of $5 or less are interested in obtaining a refund, they should contact supportca@weberstephen.com and the refund will be made to the original method of payment. Purchases made using gift cards are subject to the return policy at https://www.weber.com/CA/en/shippingandreturns.html.

Checking Your Gift Card Balance

You may review your Gift Card balance at www.weber.com/CA/en/giftcard/ or in your online cart during the checkout process at www.weber.com/CA/en/cart/ .

Lost or Stolen Gift Cards

If you suspect that someone has copied or stolen your Gift Card, contact Weber Customer Support immediately at supportca@weberstephen.com. Gift Cards will not be replaced if lost or stolen without the purchaser's confirmation email as proof of purchase. If you provide proper proof of purchase, any remaining balance on your Gift Card at time of loss can be re-issued to you on a new Gift Card. Gift Cards have cash value and should be safeguarded accordingly.

Limitations

You may not use a Gift Card to purchase other Gift Cards. Gift cards may not be used to make a payment on any credit account. Gift Cards cannot be resold, transferred for value, or redeemed for cash, except to the extent required by law. Void if resold, or transferred for value. Gift Cards may only be redeemed toward the purchase of eligible goods provided by Weber on www.weber.com/CA. The minimum value of a Gift Card is $25.  

Gift Cards purchased on the Weber Canadian website www.weber.com/CA may only be used on this website. For greater certainty, gift cards acquired on the Weber Stephen US website www.weber.com/US cannot be used on the Canadian website, and Gift Cards purchased on the Canadian website cannot be used on the Weber Stephen US Website. 

The billing address for a Gift Card purchased on the Canadian website must be in Canada.

Weber customer support may provide Gift Card purchasers with information about the redemption status of their Gift Cards.

Risk of Loss

Ownership and risk of loss of Gift Cards passes to the purchaser as soon as we send the confirmation email to the recipient. We are not responsible for lost or stolen Gift Cards. The Gift Cards may be paid for with a valid VISA, MasterCard, or American Express.

Delivery Information and Requirements for Gift Card Purchasers

All Gift Card orders are subject to a process that compares purchaser information provided on the web site with information about the purchaser provided by the purchaser's financial institution (credit/debit card charge). If there is a discrepancy, your Gift Card order may be delayed until it can be corrected. If you have concerns about your order, please contact Weber’s Customer Support. Please refer to your order number, or be ready to supply your email address. We are not responsible for Gift Cards that are undeliverable or not received due to your failure to enter an accurate address or email address for the recipient. Please check to make sure the mailing or email address of the recipient is correct and contact Weber’s Customer Support if you suspect the recipient did not receive their Gift Card.

If you purchase a gift card for someone other than yourself, you must have that persons permission to provide us with their contact information. You may only send a gift card to friends with whom you have had direct voluntary two way communications, and with whom it is reasonable to conclude you have a personal relationship considering shared interests, experiences, opinions and other relevant factors. You may only send a gift card to family members to whom you are related by marriage, a common-law partnership, or parent-child relationship, and with whom you have had direct voluntary two way communications. 

Each friend or family member will be sent an email containing the gift card you have chosen to send them. This message will be sent on your behalf and will identify you.

Reasons for Failed Gift Card Delivery

If you have confirmed the recipient's email address but the Gift Card has not been viewed within a reasonable period after the requested delivery date, the following is a list of the most common reasons why delivery may have failed:

  • Spam filter blocked email or routed it to a bulk/spam folder
  • Recipient's firewall blocked the email
  • Email inbox is over size limit
  • Invalid email address 

If a spam filter is blocking supportca@weberstephen.com emails from getting to an inbox, the email options will need to be modified so that supportca@weberstephen.com emails are not considered spam.

Limitation of Liability

NEITHER WEBER OR ITS RESPECTIVE AFFILIATES MAKE ANY WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO GIFT CARDS, INCLUDING WITHOUT LIMITATION, ANY EXPRESS OR IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IF A GIFT CARD CODE IS NON-FUNCTIONAL, YOUR SOLE REMEDY, AND OUR SOLE LIABILITY, SHALL BE THE REPLACEMENT OF SUCH GIFT CARD. CERTAIN JURISDICTIONS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MIGHT HAVE ADDITIONAL RIGHTS.
